These Terms and Conditions (“Terms”) govern your use of the railmonsters.com website and mobile applications (“Service”), owned and operated by railmonsters.com (“we,” “us,” or “our”) and its subsidiaries in the United Kingdom. By accessing or using our Service, you agree to be bound by these Terms and all applicable laws and regulations. If you do not agree with any part of these Terms, please refrain from using our Service.
1. Acceptance of Terms
By using railmonsters.com or our apps, you confirm that you have read, understood, and agreed to these Terms. If you are using our Service on behalf of an organization, you are agreeing to these Terms for that organization and confirming that you have the authority to bind that organization to these Terms.
You must be at least 16 years old to use our Service. If you are under 16, you may only use Rail Monsters with the involvement and consent of a parent or legal guardian.
2. Scope of Services
Rail Monsters operates as an international and independent reservation agency, providing an online platform for users to search for, book, and manage train tickets, accommodations, car services, eSIMs, insurance, and other travel-related services across various destinations.
Service Provider Role: Rail Monsters acts solely as an intermediary, facilitating the purchase of tickets and other services on behalf of the customer. We are not responsible for providing the actual travel services.
Advanced Technology Platform: Rail Monsters uses advanced technology to aggregate and display travel options from multiple providers, enabling you to conveniently search, compare, and book travel arrangements.
Not a Transport or Service Operator: Rail Monsters does not operate as a train operator, airline, hotel, insurance provider, or telecommunications provider. Our role is limited to facilitating the booking process between users and service providers.
Third-Party Integrations: In most cases, including eSIMs, car transfers, hotel nights, and insurance, Rail Monsters integrates directly or indirectly with third-party platforms.
We act solely as a booking intermediary and are not responsible for the delivery, quality, or outcome of those services. Your contractual relationship is with the respective service provider.
Responsibility of Service Providers: The contract for travel services is between you and the respective rail operator or third-party provider. Rail Monsters is not a party to this contract and has no responsibility or control over the quality, safety, or delivery of services provided by these entities.
Pricing Transparency: The total amount charged to the customer includes all applicable service and provider fees, as well as additional markups for certain routes or services based on our agreements with providers. Prices may differ from those offered directly by providers.
Rail Monsters may receive commission or booking fees from service providers or affiliates.
Linked Travel Arrangements Disclaimer:
Rail Monsters is not a tour operator and does not offer linked travel arrangements or package travel services as defined under Directive (EU) 2015/2302 or the UK’s Package Travel and Linked Travel Arrangements Regulations 2018.
3. Amendments to Terms
Rail Monsters reserves the right to modify or replace these Terms at any time at our sole discretion. We will endeavor to provide reasonable notice of any significant changes. Your continued use of the Service after any changes signifies your acceptance of the revised Terms.
We recommend that you review these Terms periodically. The date of the last revision is always posted at the top of this page.
4. User Registration and Account Management
Account Creation Requirements
To access certain features of our Service, you must register for an account. When creating an account, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account information, including your password.
User Responsibility for Account
You are responsible for safeguarding the password you use to access our Service and for any activities or actions under your account. Please notify us immediately of any unauthorized use. Rail Monsters cannot and will not be liable for any loss or damage arising from your failure to secure your account.
Account Termination and Inactivity
You may delete your account at any time via the account settings page. We reserve the right to suspend, deactivate, or terminate your account if there is no activity for an extended period or for any violation of these Terms, with prior notice where applicable.
5. Booking and Payment Process
Booking Process
By booking through Rail Monsters, you agree to the terms and conditions of both the rail operator and Rail Monsters. The booking process includes selecting your journey, entering passenger details, and confirming your itinerary before payment. Please review your details carefully, as errors may not be rectified after confirmation.
You will be required to confirm acceptance of these Terms and our Cancellation Policy during checkout.
Payment Methods and Security
Rail Monsters accepts multiple forms of payment, including credit/debit cards, Apple Pay / Google Pay, and other online payment platforms. All transactions are processed through secure payment gateways, and your payment details are encrypted. Rail Monsters does not store complete credit card information on our servers.
Pricing, Fees, and Markups
All prices are displayed in the currency specified on our website and include applicable taxes, our fees, and a minimum service fee of 4% per booking, with a minimum charge of $4 USD or equivalent. Prices may vary depending on the source and included in final price you see (direct or third-party) and may include markups, additional fees for provider services, and our commission. Final prices, including booking fees, are always displayed before payment.
Currency Conversion and Additional Fees
For international bookings, customers may incur currency conversion fees or foreign transaction fees from their payment provider, for which Rail Monsters is not responsible.
Rail Monsters does not control exchange rate differences or any additional charges from your bank.
6. Confirmation and Ticket Delivery
Upon successful payment, you will receive an initial confirmation of your order. This confirmation acknowledges receipt of your booking request but does not yet constitute issuance of your ticket. Following this, our team—either physically or automatically—confirms the order and places it with the rail operator or rail supplier. Once the rail operator/supplier returns the issued tickets to us, we will promptly provide them to you via email and within your Rail Monsters account.
Electronic Ticketing
Tickets are delivered electronically either to the provided email or in your account on the Rail Monsters website. In cases where ticket issuance is delayed, you will be notified of the expected issuance date. Once the tickets are delivered to the email address or account provided, Rail Monsters considers the transaction complete and all obligations fulfilled. In case that we did not deliver tickets, you will get a full refund of your order.
7. Modifications, Cancellations, and Refunds
Modification and Cancellation Policies
Change and cancellation policies are governed by the terms of the specific rail operator. Rail Monsters’ policy applies in addition. Requests must be made through your Rail Monsters account or by contacting our support team.
Customers must request cancellations and modifications via the Rail Monsters account interface. All fees, including those from the rail supplier and Rail Monsters, are displayed before confirming the request. Once cancelled, refunds are processed automatically.
Cancellations within 24 hours of departure cannot be guaranteed, except in special cases at our discretion. Specific terms and fares are shown before booking at Rail Monsters; some tickets can be non-refundable or non-exchangeable at all.
In accordance with Article 16 of Directive 2011/83/EU, customers do not have a statutory right of withdrawal for transport services with a specific date.
Refunds
Refunds are processed in accordance with the rail operator’s policies and credited to the original payment method within 5–15 business days. Rail Monsters will notify you of any fees associated with refunds. We recommend using Rail Monsters to modify or cancel tickets, as cancellations directly at the rail station may incur additional processing time and fees.
Refund eligibility and timelines are determined by the rail supplier and are beyond our control.
Non-Refundable Fees
Our service fees and any charges levied by our partners or providers are non-refundable. Customers are responsible for arriving at the station on time; missed trains are non-refundable.
8. User Responsibility for Travel Documents and Timely Arrival
Travel Documentation
It is your responsibility to ensure you possess all necessary travel documents, including valid identification, visas, and any health certifications required by local regulations. Rail Monsters is not liable for disruptions due to insufficient documentation.
Timely Arrival
Customers are responsible for arriving at the station on time. Rail Monsters is not liable for missed trains due to late arrival or missed connections.
9. Platform Availability and Information Accuracy
Service Availability
Rail Monsters strives to maintain access to its platform; however, maintenance and technical issues may affect availability. Rail Monsters is not liable for disruptions outside its control.
Accuracy of Information
While Rail Monsters makes every effort to provide accurate timetables, pricing, and availability information, we rely on third-party data and cannot guarantee its accuracy or assume liability for any discrepancies.
10. Limitation of Liability
Third-Party Service Liability
Rail Monsters is not liable for services provided by third-party operators, including rail operators, insurance providers, hotel partners, telecom platforms, or other travel partners, and is not responsible for any injury, death, loss, delay, inconvenience, or damage incurred during travel. Claims related to these matters should be directed to the relevant provider or authority.
Force Majeure
Rail Monsters is not liable for service disruptions caused by events outside our control.
Force Majeure includes, but is not limited to, natural disasters, pandemics, government restrictions, internet outages, power failures, war, terrorism, civil disturbances, labor strikes, and other unforeseen circumstances beyond our reasonable control.
Release of Liability for Missed Trains
Rail Monsters is not responsible for missed trains, loss or damage to luggage, or personal injury resulting from rail operator negligence.
11. Intellectual Property Rights
All content on railmonsters.com, including text, graphics, logos, images, and software, is the property of railmonsters.com and its subsidiaries or its content suppliers and is protected by international copyright laws. Unauthorized use or reproduction of this content is strictly prohibited.
12. Disclaimer of Warranties
“As Is” Basis
Our Service is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied. Rail Monsters does not guarantee uninterrupted or error-free service or the accuracy of information provided.
13. Indemnification
You agree to indemnify, defend, and hold harmless Rail Monsters, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses, including reasonable attorneys’ fees, arising out of your use of the Service or violation of these Terms.
14. Governing Law and Dispute Resolution
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to conflict of law principles.
Dispute Resolution
Any disputes arising from these Terms or the use of our Service shall be resolved through amicable negotiations. If a resolution cannot be reached, the disputes shall be settled by binding arbitration or in the courts of the United Kingdom.
